The New Orleans District Corps of Engineers released a special public notice today to solicit public comments regarding the use of the Modified Charleston Method as a technique for assessment of compensation requirements for adverse impacts to wetlands and other waters regulated by the Corps. The New Orleans District would like to receive all comments by October 25, 2011. See the attached public notice for more information.

Currently on Public Notice in the Federal Register is EPA and USACE Guidance Regarding Identification of Waters Protected by the Clean Water Act. The Public Notice and comment period has been extended to July 31, 2011. Visit http://www.usace.army.mil/CECW/Pages/nnpi.aspx for more information and to review the draft guidance.

The New Orleans District of the Corps of Engineers maintains a working copy of the Modified Charleston Method (MCM) workbook. This district-specific MCM workbook can be used as a tool to assist with calculation of wetland credits impacted by a project. The workbook can be accessed on the RIBITS website at https://rsgis.crrel.usace.army.mil/ribits/f?p=107:27:2528696793959644::NO:RP:P27_BUTTON_KEY:20. Make sure to select "New Orleans" in the drop-down box at the bottom left corner of the screen. Then, scroll to the bottom of the page for links to the workbook and guidebook. Because the New Orleans District frequently updates data within the workbook, such as bank information, the Corps recommends that the link be revisited every time the workbook is used.

(05-01-2011)On May 2, 2011, the Environmental Protection Agency (EPA) and U.S. Army Corps of Engineers (USACE) jointly published in the Federal Register their proposal to issue clarifying guidance for determining which waters and wetlands are protected under the Clean Water Act (CWA) programs. The agencies are soliciting comments on the proposed draft guidance from interested parties, and the comment period will be 60 days.
The proposed draft guidance is intended to improve the consistency, predictability, and transparency of jurisdictional determinations and be fully consistent with the CWA, applicable regulations, and Supreme Court decisions.
